Transfers providing a boost in college basketball

College basketball coaches all around the country are using experienced transfers to restock their rosters.

Here are six programs that have received a big boost this season from players who got their start on a different campus. Some coaches have players who followed the conventional route of sitting out a year before beginning play with their new teams. Others have players who received a waiver allowing them to play immediately. And some reeled in more than one player to replace departed stars.

Along the way, transfers have provided a welcome infusion of scoring, interior toughness and leadership.

Arizona ? Xavier's loss has been the Wildcats' gain again. Mark Lyons averaged 15 points last year, but left Xavier in what the school said was a mutual decision after Lyons butted heads with coach Chris Mack during the season. Now the senior guard is leading No. 8 Arizona (17-2) in scoring, once again averaging about 15 points as an every-game starter. "He has great belief in his own ability, but he also believes in our team," said Arizona coach Sean Miller ? who himself arrived in the desert from Xavier in 2009. "He's used to winning, he's used to playing in big games, and he's used to performing in big games. When one player feels that way, it can become contagious."

Butler ? Rotnei Clarke didn't need long to make an impact for the Bulldogs. In his third game, the Arkansas transfer had one of the season's top highlights when he buried a 25-foot heave at the buzzer to beat Marquette in the Maui Invitational. The 6-foot senior is averaging a team-best 16.7 points and shooting 43 percent on 3-pointers for ninth-ranked Butler (17-3). He scored 19 in an upset of then-No. 1 Indiana in December, then returned from a neck injury that sidelined him three games with 24 points last weekend against Temple. "We can do more with him," coach Brad Stevens said afterward. "There's no question you're going to score more with a better scorer out there and I think we'll push it a little more with him out there, too."

Canisius ? It hasn't been just the big programs that have gotten transfer help. Billy Baron started his career at Virginia, then transferred to play for his father, Jim, at Rhode Island last season before following him to long-struggling Canisius. The junior guard is averaging a team-high 16 points this season for the Golden Griffins (13-8), who are trying to earn their first winning record since the 2000-01 season and their first NCAA tournament bid since 1996. Canisius was 5-25 last year and 1-17 in the Metro Atlantic Athletic Conference, but Baron's play has helped Canisius carry a winning record into February for the first time in six years, according to STATS LLC.

Iowa State ? Cyclones coach Fred Hoiberg found help from Will Clyburn, a 6-7 guard who played in junior college and at Utah, and Michigan State transfer Korie Lucious. Clyburn is averaging a team-high 14.4 points and 7.6 rebounds, while Lucious is averaging about 10 points and 5.5 assists heading into Wednesday's game at Oklahoma State. But the two seniors are also offering leadership, with Lucious ? who played in the 2009 national-title game and the 2010 Final Four with the Spartans ? calling a players-only meeting after a loss to Texas Tech. "I just called the meeting to make sure everybody's heads was on straight," Lucious said. Iowa State responded by beating Kansas State last weekend for its first win against a ranked opponent this season.

Missouri ? Second-year Tigers coach Frank Haith could almost field an entire lineup with four transfers, three of whom sat all or most of last season. Oregon transfer Jabari Brown is second on the team in scoring at around 15 points since becoming eligible in December, while fellow guards Earnest Ross (Auburn) and Keion Bell (Pepperdine) have been part-time starters averaging at least nine points. Then there's former Connecticut forward Alex Oriakhi, a member of the 2011 NCAA championship team who was cleared to play immediately because the Huskies were banned from the NCAA tournament due to poor academics. Oriakhi is averaging about 11 points and nine boards on the interior for the 17th-ranked Tigers heading into Wednesday's game at LSU.

UCLA ? Consider this "Chapel Hill Westwood." First the Bruins added twin 6-10 forwards David and Travis Wear from North Carolina last season. Then they added another former Tar Heel this year in point guard Larry Drew II, who quit the team at UNC in 2011 at midseason after losing his starting job to Kendall Marshall. After two-plus years of uneven play for Roy Williams, the senior entered the week ranked fourth nationally in assists (eight per game) and first in assist-to-turnover ratio (4.6). As for the Wears, Travis is a starter averaging 12 points and six rebounds, while David is averaging about seven points and five boards off the bench for Ben Howland's Bruins heading into Wednesday's game against USC.

Twitter cleans up Vine's hashtags, censors #porn, #sex, other naughty terms

According to the folks at Twitter, an innocent "human error" was to blame when a pornographic video was featured as an "Editor's Pick" on Vine, but this incident?? combined with a?lack of privacy and abuse prevention controls?? makes it seem as if there's a bit of a porn problem on the new?video-sharing service.

The sudden censorship of certain hashtags further solidifies that belief.

The Verge's Nathan Ingraham was among the first to point out that it appears that the searches for certain naughty hashtags ??such as #porn, #sex, #booty?and similar ??are bringing up no results, even though there are certainly posts with those hashtags.?

I tested this claim by creating a post and tagging it #nsfw. Nothing prevented me from creating this post?? which was entirely innocent, don't worry?? but neither tapping on the hyperlinked hashtag nor searching for #nsfw brought it (or any other posts) into view. Instead, I was shown a frowning emoticon and told that Vine couldn't load any posts. (In the case of searches, the frowning emoticon informed me that no tags matching that term?exist.)?

We have reached out to Twitter to inquire about the missing search results and to see if some sort of cleanup is occurring behind the scenes.?"We're in the process of changing how users find and view sensitive content," a spokesperson explained. "We're experimenting with a number of approaches and will continue to iterate."

(AP) ? Ashley Judd and Dario Franchitti are separating after 11 years of marriage.

Judd's spokeswoman confirmed a Tuesday report from People magazine that the 44-year-old actress and 39-year-old Scottish race car driver are ending their marriage.

The star of such films as "Double Jeopardy" and "Kiss the Girls" says in a statement that the pair will "always be family" and will continue to cherish their relationship based on love, integrity and respect.

Last year, Judd starred in the ABC series "Missing" and attended the Democratic National Convention as a Tennessee delegate.

Franchitti has won the Indianapolis 500 race three times.

The couple wed in a private ceremony in Scotland in 2001.

Wash. vows to try to keep weed in state -- but how?

SEATTLE (AP) ? So far, no one is suggesting checkpoints or fences to keep Washington state's legal pot within its borders.

But Gov. Jay Inslee insists there are ways to prevent the bulk smuggling of the state's newest cash crop into the black market, including digitally tracking weed to ensure that it goes from where it is grown to the stores where it is sold.

With sales set to begin later this year, he hopes to be a good neighbor and keep vanloads of premium, legal bud from cruising into Idaho, Oregon and other states that don't want people getting stoned for fun.

It's not just about generating goodwill with fellow governors. Inslee is trying to persuade U.S. Attorney General Eric Holder not to sue to block Washington from licensing pot growers, processors and sellers. Marijuana remains illegal under federal law.

"I am going to be personally committed to have a well regulated, well disciplined, well tracked, well inventory-controlled, well law-enforcement-coordinated approach," said Inslee, who is due to give Holder more details this week.

Keeping a lid on the weed is just one of the numerous challenges Washington state authorities and their counterparts in Colorado ? where voters also legalized pot use ? will face in the coming months.

The potential of regulatory schemes to keep pot from being diverted isn't clear. Colorado already has intensive rules aimed at keeping its medical marijuana market in line, including the digital tracking of cannabis, bar codes on every plant, surveillance video and manifests of all legal pot shipments.

But law enforcement officials say marijuana from Colorado's dispensaries often makes its way to the black market, and even the head of the Colorado agency charged with tracking the medical pot industry suggests no one should copy its measures.

The agency has been beset by money woes and had to cut many of its investigators. Even if the agency had all the money it wanted, the state's medical pot rules are "a model of regulatory overreach," too cumbersome and expensive to enforce, Laura Harris said in a statement.

Last fall, voters made Washington and Colorado the first states to pass laws legalizing the recreational use of marijuana and setting up systems of state-licensed growers, processors and retail stores where adults over 21 can walk in and buy up to an ounce of heavily taxed cannabis.

Both states are working to develop rules for the emerging pot industry.

The Obama administration could sue to block the legal markets from operating, on the grounds that actively regulating an illegal substance conflicts with federal drug law. The DOJ is reviewing the laws but has given no signals about its plans.

It has never sued states like Colorado that have regulated medical marijuana, even though it could under the same legal principles.

Part of the DOJ's political calculus in deciding whether to sue is likely to be how well the department believes the two states can keep the legal weed within their borders. During a meeting with Inslee last week, Holder asked a lot of questions about diversion, Inslee said.

Alison Holcomb, who led Washington's legal pot campaign, said it's important to respect states that haven't legalized weed by not flooding their black markets. The first step, she said, is for the state to figure out how much pot should be produced, and then grant licenses accordingly.

"Excess supply creates incentive to divert outside the state," she said.

Washington's Liquor Control Board is planning a comprehensive survey to estimate how much marijuana is consumed in the state.

Inslee has boasted about the effectiveness of the State Patrol's highway interdiction program in stopping drug trafficking. Traditional police work, combined with inventory controls, will be key to clamping down on diversion, he said.

Digital tracking of the weights of marijuana shipments between processors and retailers would help make sure there isn't "10- to 20-percent shrinkage that's going to the black market," he said.

But even if the state can prevent bulk pot from being diverted, there's nothing to keep customers from walking into multiple stores, or returning to the same store, to collect more than their 1-ounce limit. Some traffickers could recruit many people to buy weed for them.

Tom Gorman, head of the Rocky Mountain High Intensity Drug-Trafficking Area, said efforts to keep a lid on legal marijuana simply don't work.

Pot from Colorado's medical marijuana system ? often described as the most closely regulated in the world ? routinely makes its way into Kansas, Nebraska, Wyoming and points east, often from dispensaries that have sold out the back door, he said.

A brief law enforcement survey the organization conducted last summer turned up numerous cases in which suspects had made purchases at Colorado dispensaries before being busted in other states.

In the past two years, Colorado's medical pot regulators have levied 54 fines against licensed businesses, but have never revoked or suspended a license.

Matt Cook, the former director of Colorado's Medical Marijuana Enforcement Division, defended the "seed-to-store" regulations in the state.

Cook, who is applying for a job as a consultant to Washington's marijuana regulators, noted that at any time officials could check the digital records, pull the surveillance video or drop in for an inspection ? and the fear of getting busted keeps people in line.

Bob Hoban, whose law firm represents nearly 100 medical marijuana businesses in Colorado, agreed, and noted another incentive for dispensaries to behave.

"It's a cutthroat business," he said. "If somebody sees something unusual, they're going to provide a tip. ... There's just about as good of a safeguard as you can have for diversion in the state of Colorado, and a lot of that is Big Brother watching you."

Working to identify early warning signs in juvenile offenders

Jan. 29, 2013 ? Red flags are easy to recognize in the days following a tragic event like a mass shooting. That's why a group of Iowa State researchers is working to identify those early warning signs in juvenile offenders before they turn into a pattern of criminal behavior.

It is often difficult for people to understand what leads to criminal behavior in children or teens. But by the time a juvenile is arrested, or referred to the juvenile court system, the child generally has displayed a pattern of antisocial behavior, said Matt DeLisi, professor of sociology at Iowa State University.

In some extreme cases, DeLisi said children as young as 5 years old are committing crimes. So when that child becomes an adult, he or she may already have a lengthy criminal record. That is why DeLisi, and the team of researchers, wants to understand what contributes to this behavior in order to correct it.

"With onset in criminal careers, the first sign of that problem behavior is an indicator of how severe it will be," DeLisi said. "If you can help them, you save a ton of money and you save a lot of problems. But it's just the issue of correctly identifying them and that raises a bunch of ethical and other issues."

The connection between the onset and the severity is similar to other ways children start to develop, whether it is positive or negative, at an early age.

"If you have someone who is 3, or even 2, and is already reading it would suggest that the person is highly intelligent," DeLisi said. "The reason is because the emergence or the onset of the behavior is usually inversely related to what they will become. The earlier something appears the more special they are or extreme."

With criminal behavior, the onset begins with rule violations, but researchers found a juvenile's first arrest or contact with the police is the strongest indicator of future problems. The study published in the Journal of Criminal Justice included 252 children living in Pennsylvania juvenile detention centers. The offenders ranged in age from 14-18 and on average had committed 15 delinquent acts in the prior year.

Researchers also discovered that children with attention deficit hyperactivity disorder got into trouble at a younger age than other juvenile offenders without ADHD. In fact, their first contact with police happened more than a year prior to other offenders. Youth with conduct disorder were also more likely to be arrested at a younger age. However, researchers urge caution on how the results are interpreted.

"This by no way means that every child with ADHD or conduct disorder will become delinquent or ultimately be arrested. What it does mean is that future work needs to address why some youth with ADHD or conduct disorder become delinquent and others do not," said Brenda Lohman, an associate professor in human development and family studies at Iowa State.

"From a preventive standpoint, this information could then help identify support systems and intervening mechanisms for families and parents, and ultimately decrease rates of antisocial behaviors of children with ADHD or conduct disorder," Lohman said.

In addition to preventive measures, researchers hope to build on this study to better understand the family dynamics that can lead to mental and behavioral issues in children.

"Extensive research indicates that economic hardship has an adverse effect on the well-being of families," said Tricia Neppl, an assistant professor in human development and family studies at Iowa State.

Economic pressures increase the risk for emotional distress, which Neppl said can lead to harsh disciplinary practices. She is working on a study to determine if such hardships, when a child is between the ages of 3 and 5 years old, impact the child's mental health when they are 6 to 13 years old.

"The results suggest that economic adversity influences parental emotional health, marital distress, and hostile parenting which predicts child mental health disorders, such as conduct disorder and ADHD, during later childhood and early adolescence," Neppl said.

As researchers understand more about the connection with antisocial behavior, DeLisi expects there will be an even greater push for intervention and treatment for ADHD and conduct disorder.

"Early interventions are very successful, but they require a lot of investment on the part of people who may be the least willing or able to invest," DeLisi said. Researchers from the University of Pittsburgh and Saint Louis University also contributed to the study.

Seoul pulls Asian shares down, solid economic data helps

TOKYO (Reuters) - Tech-heavy South Korean shares dragged down the broader Asian share index on Monday on fears of weaker earnings, but improving economic prospects in Europe and solid U.S. profit reports underpinned sentiment.

The MSCI's broadest index of Asia-Pacific shares outside Japan <.miapj0000pus> inched down 0.2 percent, after seeing its biggest weekly loss in two months last week. Asian markets were in positive territory except in Seoul and Jakarta.

The Korea Composite Stock Price Index (KOSPI) <.ks11> extended losses to an 8-week low with a 0.6 percent slip, as a weakening yen soured the outlook for local exporters and foreign investors reduced their holdings.

Tech-heavy South Korea was also vulnerable to a clouding outlook for high-end smartphone device shipments.

"Investors have begun preempting concerns about exporters' outlooks since automakers announced weak earnings last week, while large-caps continue to be pressured by foreign selloffs," said Kim Hyung-ryol, an analyst at Kyobo Securities.

Global investor sentiment improved on Friday when the German Ifo business morale index improved in January to its highest in more than half a year, further evidence that Europe's largest economy is gathering speed again, and European banks were set to repay the European Central Bank a larger sum of money than expected to underscore stabilising financial system in the euro zone.

In China, data on Sunday showed profits earned by industrial companies rose 17.3 percent in December from a year earlier to 895.2 billion yuan ($143.9 billion), adding to evidence of a fourth-quarter economic recovery.

The yen extended losses to fresh lows, but Japanese equities gave up earlier gains and eased ahead of Japan's corporate reporting season which enters full swing this week.

Japan's Nikkei stock average <.n225> edged down 0.1 percent after jumping 2.9 percent on Friday to log an 11th straight week of gains, its longest such run since 1971. <.t/>

Against the yen, the dollar hit 91.26 early on Monday, its highest level since June 2010 while the euro touched 122.91, its highest point since April.

New Prime Minister Shinzo Abe has called for aggressive monetary easing and huge fiscal spending to beat deflation. The yen has fallen some 13 percent since mid-November when he began making those calls as part of his election campaign.

"The potent mix of Abenomics and strong risk appetite abroad is continuing to soften the yen, which means investors will still be buying stocks," said Masayuki Doshida, senior market analyst at Rakuten Securities.

In sharp contrast to U.S. and German equities, the Nikkei remains well below levels before the financial crisis in 2008, reflecting the magnitude of negative effect from the yen's strength. The benchmark Standard & Poor's 500 Index <.spx> closed at their highest in more than five years on solid U.S. corporate earnings on Friday and Frankfurt's DAX index <.gdaxi> also scaled five-year highs.

The yen is still stronger than around 95 yen before the 2008 financial crisis, but both the euro and the dollar measured against a basket of key currencies <.dxy> hover at levels far below the pre-crisis levels.

The improving global macroeconomic environment has curbed interest in safe haven assets such as gold.

Spot gold steadied around $1,659.90 (1,053.44 pounds) an ounce on Monday, still below its 200-day moving average. As riskier equities rallied on Friday, bullion saw its biggest weekly drop this year on Friday.

U.S. crude inched up 0.1 percent to $95.95 a barrel and Brent steadied around $113.23.

London copper, another industrial commodity linked to demand prospects, rose 0.4 percent to $8,065 a tonne.

With easing stress in financial markets, investors pumped $5.65 billion into stock funds worldwide in the latest week, with most of it flowing into emerging market stock funds, data from EPFR Global showed on Friday.

The euro hovered near an 11-month high of $1.3480 hit on Friday. The Australian dollar stumbled to an eight-month low against the euro early on Monday. European shares scaled fresh multi-month peaks on Friday.

Investors will focus this week on the Federal Reserve's Open Market Committee statement on Wednesday and U.S. nonfarm payrolls due on Friday.

Sluggish equities weighed on Asian credit markets, widening the spread on the iTraxx Asia ex-Japan investment-grade index by 1 basis point.

Vatican City, 26 January 2013 (VIS) ? This morning in the Clementine Hall of the Apostolic Palace, the Holy Father received members of the Tribunal of the Roman Rota on the occasion of the opening of the judicial year. His address, from which ample extracts follow, focused on the relationship between faith and marriage in light of the "current crisis of faith that affects various areas of the world, bearing with it a crisis of conjugal society."

?The Code of Canon Law defines the natural reality of marriage as the irrevocable covenant between a man and a woman. Mutual trust, in fact, is the indispensable basis of any agreement or covenant. On a theological level, the relationship between faith and marriage has an even deeper meaning. Even though a natural reality, the spousal bond between two baptised persons has been elevated by Christ to the dignity of a sacrament.?

?Contemporary culture, marked by a strong subjectivism and an ethical and religious relativism, poses serious challenges to the person and the family. First, the very capacity of human beings to bond themselves to another and whether a union that lasts an entire life is truly possible. ? Thinking that persons might become themselves while remaining ?autonomous? and only entering into relationships with others that can be interrupted at any time is part of a widespread mentality. Everyone is aware of how a human being's choice to bind themself with a bond lasting an entire life influences each person?s basic perspective according to which they are either anchored to a merely human plane or open themselves to the light of faith in the Lord.?

"?Whoever remains in me and I in him will bear much fruit, because without me you can do nothing,? Jesus taught His disciples, reminding them of the human being?s essential incapacity to carry out alone that which is necessary for the true good. Rejecting the divine proposal leads, in fact, to a profound imbalance in all human relationships, including marriage, and facilitates an erroneous understanding of freedom and self-realization. These, together with the flight from patiently borne suffering, condemns humanity to becoming locked within its own selfishness and self-centredness. On the contrary, accepting faith makes human persons capable of giving themselves ? and thus of discovering the extent of being a human person."

?Faith in God, sustained by God?s grace, is therefore a very important element in living mutual devotion and conjugal faithfulness. This does not mean to assert that faithfulness, among other properties, are not possible in the legitimate marriage between unbaptised couples. In fact, it is not devoid of goods that ?come from God the Creator and are included, in a certain inchoative way, in the marital love that unites Christ with His Church?. But, of course, closing oneself off from God or rejecting the sacred dimension of the conjugal bond and its value in the order of grace make the concrete embodiment of the highest model of marriage conceived of by the Church, according to God?s plan, arduous. It may even undermine the very validity of the covenant if ? it results in a rejection of the very principle of the conjugal obligation of faithfulness or of other essential elements or properties of the marriage.?

?Tertullian, in his famous ?Letter to His Wife?, which speaks about married life marked by faith, writes that Christian couples are truly ?two in one flesh. Where the flesh is one, one is the spirit too. Together they pray, together prostrate themselves, together perform their fasts; mutually teaching, mutually exhorting, mutually sustaining one another.?"

?The saints who lived their matrimonial and familial union within a Christian perspective were able to overcome even the most adverse situations, sometimes achieving the sanctification of their spouse and children through a love reinforced by a strong faith in God, sincere religious piety, and an intense sacramental life. Such experiences, marked by faith, allow us to understand, even today, how precious is the sacrifice offered by the spouse who has been abandoned or who has suffered a divorce?'being well aware that the valid marriage bond is indissoluble, and refraining from becoming involved in a new union. ? In such cases their example of fidelity and Christian consistency takes on particular value as a witness before the world and the Church'.?

Lastly, I would like to reflect briefly on the ?bonum coniugum?. Faith is important in carrying out the authentic conjugal good, which consists simply in wanting, always and in every case, the welfare of the other, on the basis of a true and indissoluble ?consortium vitae?. Indeed, the context of Christian spouses living a true ?communio coniugalis? has its own dynamism of faith by which the ?confessio??the personal, sincere response to the announcement of salvation?involves the believer in the action of God?s love. ?Confessio' and ?caritas? are 'the two ways in which God involves us, make us act with Him, in Him and for humanity, for His creation. ? ?Confessio? is not an abstract thing, it is ?caritas?, it is love. Only in this way is it really the reflection of divine truth, which as truth is also, inseparably, love'.?

?Only through the call of love, does the presence of the Gospel become not just a word but a living reality. In other words, while it is true that ?Faith without charity bears no fruit, while charity without faith would be a sentiment constantly at the mercy of doubt?, we must conclude that ?Faith and charity each require the other, in such a way that each allows the other to set out along its respective path.? If this holds true in the broader context of communal life, it should be even more valuable to the conjugal union. It is in that union, in fact, that faith makes the spouses? love grow and bear fruit, giving space to the presence of the Triune God and making the conjugal life itself, lived thusly, to be ?joyful news? to the world.?

?I recognize the difficulties, from a legal and a practical perspective, in elucidating the essential element of the ?bonum coniugum?, understood so far mainly in relation to the circumstance of invalidity. The ?bonum coniugum? also takes on importance in the area of simulating consent. Certainly, in cases submitted to your judgement, there will be an ?in facto? inquiry that can verify the possible validity of the grounds for annulment, predominant to or coexistent with the three Augustinian ?goods?: procreativity, exclusivity, and perpetuity. Therefore, don?t let it escape your consideration that there might be cases where, precisely because of the absence of faith, the good of the spouses is damaged and thus excluded from the consent itself. For example, this can happen when one member of the couple has an erroneous understanding of the martial bond or of the principle of parity or when there is a refusal of the dual union that characterizes the marital bond by either excluding fidelity or by excluding the use of intercourse ?humano modo?.

?With these considerations I certainly do not wish to suggest any facile relationship between a lack of faith and the invalidity of a marital union, but rather to highlight how such a deficiency may, but not necessarily, damage the goods of marriage, since the reference to the natural order desired by God is inherent to the conjugal covenant.?

(AP) ? J.J. Abrams calls getting assigned to direct the seventh live-action "Star Wars" film "as surreal as it is exciting."

The director-producer-writer spoke with a handful of media outlets on the red carpet before darting into the Producers Guild Awards on Saturday night. Abrams was there to accept the Norman Lear Achievement Award for such television works as "Felicity" (1998-2002), "Alias" (2001-2006), "Lost" (2004-2010), "Fringe" (2008-2013) as well as the current series "Person of Interest" and "Revolution."

Abrams also is proving to be a go-to director of successful new films for long-established franchises, such as "Star Trek" and "Mission: Impossible."

Last week, Lucasfilm officially announced Abrams' hiring for "Star Wars: Episode VII," which has a tentative release date of 2015. "Star Wars" creator George Lucas personally endorsed Abrams in a statement: "I've consistently been impressed with J.J. as a filmmaker and storyteller. He's an ideal choice to direct the new Star Wars film and the legacy couldn't be in better hands."

As for Abrams' plans for "Episode VII"?

"You know, obviously, it's so early," he replied. "I can just say what I want to do: I want to do the fans proud. I want to make sure the story is something that touches people. And we're just getting started. I'm very excited."

(AP) ? Illinois is the fourth state to allow illegal immigrants to obtain a driver's license with a new law signed by the governor.

Democratic Gov. Pat Quinn signed the legislation Sunday surrounded by hundreds of supporters who say the measure will make Illinois' roads safer and expand opportunities for illegal immigrants.

Quinn says people need a way to get to work, drive to the doctor and drive their children to school. Chicago Mayor Rahm Emanuel says the new law should serve as a model for the nation.

New Mexico and Washington both issue licenses to undocumented immigrants, while Utah issues permits.

Illinois officials say the dissemination of the temporary licenses is expected to begin in November.

The legislation was billed as a public safety measure and had bipartisan support.

The Zen Of LTBH Investing In Volatile Small Caps: Organova, A ...

Ah, Grasshopper, so you are troubled by the changing value of your share in Organova Holdings, Inc. (ONVO.PK)? You say in June it was worth $10.90 and three weeks later it was worth $1.93. You say that throughout most of December, it was worth little more than $2.00, but Monday of this week it rose to $6.00 before falling Tuesday to as low as $4.00, and now you wonder about tomorrow? Sit down Grasshopper, stop pulling your hair, and listen to how a LTBH Zen Master waits for a butterfly to stop its fluttering and alight.

Transformative Technologies and the LTBH Investor

We are long-term, buy and hold ("LTBH") investors, you and I, and so we hold a mixture of value and growth equities. A subcategory of our growth equities is companies possessed with the potential of a transformative technology.

By transformative technology, we mean a unique, proprietary product with the potential to fundamentally change a significant aspect of the market.

Some of companies with transformative potential are large and established, like International Business Machines Corporation (IBM) with its big data and carbon nanotube technologies or ABB, Ltd. (ABB) with its direct current circuit breaker. These companies lumber across the earth with nary a sideways glance; there are no predators large enough to harm them, only choosing a wrong path leading to a barren landscape threatens their existence.

Others are smaller and fear predators; they scurry through the underbrush, eating smaller creatures but growing in confidence, companies like Nuance Communications, Inc. (NUAN) with voice-recognition technologies or Clean Energy Fuels Corp. (CLNE) providing natural gas fueling to truckers.

And still others are the smallest of all, tiny little companies just emerging from their nests or pupa, companies like Arcam AB (AMAVF.OB) selling a few dozen high end 3D printers annually to aerospace and medical companies, or Organova Holdings, Inc., developing the 3D printing of human tissue.

It is these babes that cause us such worries, Grasshopper. Like little ONVO, recently emerged and starting to flutter its wings. If we watch it too closely, we become dizzy with its ups and downs. The Zen of LTBH investing, Grasshopper, is to visualize the path and not watch the fluttering.

The LTBH Philosophy

Remember, Grasshopper, why we are LTBH investors and not day traders, mutual fund, or ETF investors:

  • Equity markets offer superior returns to many other investing options, so we ask not whether to invest in equities, we ask how to invest in equities
  • We know the path of frequent trading costs more in broker fees, capital gains taxes, time and energy
  • We know what we cannot know; professional traders have the edge in timeliness of information, speed of execution, and transaction costs
  • We know that, with discipline, we can win against mutual funds (because of their burden of fees and expenses and, in some cases, our ability to invest in smaller companies) and we can win against ETFs (because of their expenses and our ability to be more selective).

The LTBH Rationale for Investing in Organova

Remember, Grasshopper, the reasons why we invested in Organova. Its transformative technology is the 3D printing of human tissues for drug discovery and development, biological resources, and therapeutic implantation. It is conceivable that one day Organova machines could print entire human organs like a liver, a kidney or a heart to be therapeutically implanted into a person and save their life. This potential is the very embodiment of a transformative technology.

Yet we also know that Organova is still a delicate creature. It is a long way from having a proven product and it is incurring substantial operating losses. In the third quarter of 2012, according to its 10Q filing and an excellent Seeking Alpha article by PropThink, it had essentially three sources to its $469,238 operating revenue:

  • $298,800 in collaboration fees from United Therapeutics (UTHR)
  • $75,000 in collaboration fees from Pfizer (PFE). This collaboration expired in December 31, 2012 and is expected to be replaced with a new agreement, but no such agreement has yet been announced.
  • $95,500 from a National Institutes of Health grant

We know its expenses are running at 182% of revenues, comprised of selling, general and administrative expenses at $550,157 and research and development expenses at $304,251. But still the tiny company expresses confidence in its financial position. At September 30, 2012, they report having working capital of $7.2 million, "sufficient to fund our ongoing operations? for at least the next 12 months." In addition, Organova is in the process of resolving outstanding stock options that will remove a large liability from its balance sheet and position it to move from OTC to the NASDAQ capital markets in 2013.

What is Organova's Future Value?

We do not know what the future holds for Organova, only that it lies somewhere on a continuum between nothingness and becoming a multi-billion dollar behemoth. The possibilities are likely distributed on a bell-shaped curve with some outcome towards the middle as the most likely.

But with this knowledge, and some simple probability calculations, we can formulate an estimate of Organova's long-term value and thus find a Zen-like peace as the market flutters before us. Consider Organova's future as depending on two key issues: (1) proving great value in the 3D printing of human tissue and (2) establishing exclusivity or dominance with this technology. If both of these issues develop strongly in Organova's favor, it will become fabulously valuable. But there's a high degree of risk that one or both may not fully occur. There may be as yet undiscovered technical reasons why 3D printing is not feasible, or why it will be supplanted by another, superior method of creating human tissue. Another company may invent an alternative method for 3D printing of human tissue without violating Organova's intellectual property rights.

Using these two issues, we can project a range of potential outcomes for Organova and lay the basis for calculating an expected present value of the stock. As an example, I would propose that each of the following five scenarios are potential outcomes for Organova:

  • Scenario #1: Organova has minimal value (five year target share price $0 to $2). 3D printing of human tissue proves to have little value. Organova may go out of business, be acquired by someone else, or survive as a small company selling a limited number of 3D printers to research organizations.
  • Scenario #2: Organova has a value of $100 million to $500 million (five year target share price $2 to $10). Organova has annual earnings of $10 to $25 million a few hundred to a few thousand 3D printers annually, plus supplies and technical support, again to research organizations.
  • Scenario #3: Organova has a value of $500 million to $2 billion (five year target share price $10 to $40). 3D printing of human tissues becomes a standard mainstream research methodology and Organova is the premier provider of this technology. Many thousands of printers are sold annually. Organova trends towards annual earnings in the range of $50 to $100 million.
  • Scenario #4: Organova has a value of $2 to $5 billion (five year target share price $40 to $110). 3D printing of human tissues becomes an accepted therapeutic methodology for creating implants. There are competitors who have created alternatives around Organova's intellectual property protections. Organova shows the potential to generate eventual earnings in the hundreds of millions.
  • Scenario #5: Organova has a value of more than $5 billion (five year target share price more than $110). 3D printing of human tissues is an accepted therapeutic methodology and there are effectively no competitive alternatives. Organova has the potential to generate tens of billions in revenues and billions or more in earnings.

Don't Panic! Stay Calm. Ommmm?

So, Grasshopper, do you know that it's not the fluttering of the stock price that concerns us, it's the journey's end. If you agree with the assumptions I've described, we can assign probabilities to each, estimate what Organova's value might be if each scenario occurred, and then calculate an expected value. (If you don't agree with the assumptions I've described, it's a simple exercise to create your own). Look at this table I've drawn here in the sand:

In Scenario #2, for example, Organova shares would have an estimated value of $2.00 in five years. Discounting this by 10% per year, we calculate a Net Present Value of $1.24. We assume this scenario has a 20% chance of occurring, so the expected value of Scenario #2 is $0.24. By adding the expected value of all the outcomes we identified, we arrive at a share value today that reflects our expected returns: $20.12.

Meditate on this, Grasshopper, for this guides us to know where our "buy", "sell" and "hold" prices lie. If the price tomorrow hits $20.12, we should sell. We might even sell for a little bit less than this in order to grab a sure thing. But we aren't going to sell for, say, $12.00 what we think is worth $20.12.

To find our "buy" and "hold" points, we must reflect deeply on what our table of probabilities is telling us. One thing it tells us that there's a 60% chance that Organova isn't worth more than $6.21 today. The only reason we're not selling at $6.21 is because we're hoping that Scenario #4 or #5 will occur and Organova is a "home run" stock. Yet our assumptions say that, much as we might hope this will happen, the odds less than 50%.

So, Grasshopper, I would certainly not "buy" Organova at more than $6.21. In fact, being somewhat cautious, I would likely split the difference between the $6.21 and the $1.24 and use the resulting $3.72 as the most I would pay. My rationale is that $3.72 is the point where I have a 50% chance of getting at least a 10% return on my investment over the next five years. (Note, however, that if I get less than a 10% return, it will probably only be a little less; on the other hand, if I get more than a 10% return, I might get much, much more).

I believe, Grasshopper, that LTBH investors should have a small place for volatile small-cap stocks in their portfolios. Not just one, but several because the chances of any one being a home run is small, but the return from a home run will offset losses from the others which don't develop.

As we hold these stocks, we need to realize that there are others who trade using different philosophies. There will be great volatility in many small stocks. Don't let the fluttering of the butterfly become a fluttering in your stomach. Keep your eye on the prize, Grasshopper. We LTBH investors are not looking to sell at $4 or $6 or $10; while we continue to believe this stock can be a home run, we're holding. I find that doing this sometimes requires the patience of a Zen master.

Unlike Sandy, the nameless North Atlantic superstorm poses no threat to land. But it does highlight the power such storms can attain.

It's forecast to develop winds of up to 98 miles an hour, while the air pressure at its center ? expected to reach a low between 920 to 930 millibars ? would rival that of a category 4 hurricane, according to forecasters at the National Oceanic and Atmospheric Administration's Ocean Prediction Center in College Park, Md.

The system is the same storm "that gave us some snow a couple of days ago in DC," says Robert Banks, a forecaster at the Ocean Prediction Center. The storm intensified as the cold air moved out over relatively warm North Atlantic water, which is feeding energy into the system.

In addition, the system is merging with two other upper-level troughs ? providing the storm with yet more punch.

It's not clear how this storm will fare in the record books, Mr. Banks says. But over at the Weather Underground's web site, data gathered by British weather historian Stephen Burt shows five other storms between 1824 and 1986 with central pressures ranging from 920.2 to 925.6 millibars.

An extra-tropical superstorm in January 1993 holds the record for low pressure ? 913 millibars ? for North Atlantic winter storms in an event that destroyed an oil tanker after it ran aground at the Shetland Islands. The tanker, the MV Braer, was carrying 85,000 tons of crude oil.

The latest numbers from Nielsen indicate that 5.1 million households are getting over-the-air reception and supplementing it with Internet-delivered pay programming. Procter & Gamble shows turnaround taking hold with results, outlook

(Reuters) - Procter & Gamble Co's quarterly profit soared past expectations as the world's largest household products maker used higher prices and new products to drive sales growth, the strongest indication yet that turnaround efforts are paying off.

The results, along with improved forecasts for the fiscal year, follow months of criticism from analysts and most notably from activist investor William Ackman, who blamed P&G's top brass, led by Chairman and Chief Executive Bob McDonald, for earlier missteps.

Shares of P&G, the maker of Pampers diapers and Gillette razors and a component of the Dow Jones industrial average <.dji>, jumped as high as $73.25 in morning trading, their highest level in all of McDonald's 3-1/2 years at the helm.

"They've been stuck in the mud for years and this is kind of a ray of hope for the company and they should be commended on the quarter," said Channing Smith, co-manager of the Capital Advisors Growth Fund . P&G represents 2 percent of that fund.

The results, with profit and sales ahead of analysts' expectations, come after months of efforts by P&G to reignite growth in sluggish markets such as the United States while also expanding in emerging markets, where it typically sells lower-priced merchandise.

Back in April 2012, analysts took McDonald to task on a tense conference call after P&G cut its outlook. That summer, Ackman's Pershing Square Capital Management bought the company's shares and began pushing for more change.

Profit has exceeded analysts' expectations every quarter since, helped by new products such as Tide Pods single-dose laundry detergent.

Still, P&G's growth lags that of peers such as Unilever Plc .

P&G's organic sales, which strip out the impact of divestitures and foreign exchange, grew 3 percent in the latest quarter, while Unilever posted 6.9 percent sales growth on Wednesday.

P&G's rivals such as Unilever, Colgate-Palmolive Co and Kimberly-Clark Corp have done well in recent years while Procter struggled, and now perhaps it has the firepower to bounce back, said Edward Jones analyst Jack Russo.

"Procter's been left out of the party a little bit, so it's nice to see them reappear here and kind of exert their influence on the group," he said.

P&G has seen U.S. volume growth continue in January, said Chief Financial Officer Jon Moeller. At the same time, it believes it can improve market share in Europe over the next few months with products such as a new Ariel detergent based on the successful U.S. Tide Pods, McDonald said.

Still, analysts would like to see more improvement in other areas. Stifel Nicolaus analyst Mark Astrachan called the results "solid and encouraging," particularly the sales growth, but said P&G continues to lag in categories with strong growth trends, such as beauty.

Meanwhile, rival Kimberly-Clark also posted a better-than-expected profit on Friday.

ANSWERING ACKMAN

P&G has been under pressure to improve performance since Ackman bought a stake of about 1 percent, making his Pershing Square the company's eighth-largest shareholder. Ackman has said many of the company's problems were the fault of top management but said in the fall he understood the board wanted to give McDonald more time to repair years of damage.

"When the company is performing, obviously the pressure from Ackman will probably fade somewhat," said Capital Advisors' Smith, adding that while he does not know Ackman's intentions, it is clear that Ackman's investment in P&G is worth a lot more today than when he bought the shares.

Ackman could not immediately be reached for comment.

Even before Ackman took a stake, P&G was going through a $10 billion restructuring and other changes. It cut 5,500 nonmanufacturing jobs through December, near its goal of reducing 5,700 positions by the end of June, Moeller said on Friday.

Competitors such as Colgate and Kimberly-Clark are also trimming their ranks.

P&G earned $4.06 billion, or $1.39 per share, in the fiscal second quarter ended in December, up from $1.69 billion, or 57 cents per share, a year earlier.

Stripping out unusual items such as restructuring charges and acquisitions, P&G earned $1.22 per share. That topped the company's own forecast of $1.07 to $1.13 per share and analysts' average target of $1.11, according to Thomson Reuters I/B/E/S.

Net sales rose 2 percent to $22.18 billion, topping analysts' forecast of $21.91 billion.

P&G expects fiscal 2013 core earnings of $3.97 to $4.07 per share, up from an earlier forecast of $3.80 to $4. The fiscal year ends in June. Analyst estimates were at the bottom of that new range.

It expects organic sales to rise 3 to 4 percent this year, narrowing a prior forecast of 2 to 4 percent growth.

P&G also said it now plans to repurchase $5 billion to $6 billion in stock after calling for $4 billion to $6 billion in buybacks.

For the current quarter, P&G forecast core earnings per share of 91 to 97 cents, with sales up 3 to 4 percent. Analysts' average forecast was 95 cents per share.

Shares of P&G were up 3.7 percent at $73.00 late on Friday morning, off an earlier high at $73.25.
