Video: Police give emotional testimony at Aurora hearing



>>> during a preliminary hearing for that suspect in the movie theater massacre in aurora, colorado. the shooting left 12 people dead, 58 others injured. mike taibbi is at the courthouse in centennial. good morning to you.

>> reporter: good morning, matt. prosecutors haven't said whether they will seek the death penalty . he could end up with a sentence of life in prison without the possibility of parole. in this hearing, the details of exactly what happened just after midnight last july 20th are being made public for the first time. more than 100 victims, relatives and victims' survivors packed the courtroom and two overflow rooms to hear details of the case against james holmes , disheveled and bearded in court and seemingly uninterested in the proceedings. the young police officer who arrested holmes said at first he thought he was a s.w.a.t. team cop because of the way he was dressed but put him in handcuffs because he was just standing there outside theater nine, quote, very, very relaxed. he seemed very relaxed. the latest batman movie just started, holmes having bought his ticket online weeks before, evidence of prior planning says one psychiatrist.

>> you can be in a detached state of mind , psychotic state of mind , not clear thinking poor judgment state of mind because of the mental health problem or something else and be planning this stuff and premeditated it.

>> reporter: police witnesses nearly broke up, describing the scene. officer justin grisol explaining he rushed six of the victims in his car because, he whispered, i didn't want them to die. when he checked the littlest victim, 6-year-old veronica mosur sullivan, when and found no pulse.

>> i want to make sure that the integrity of the case is intact so that we don't have to repeat this in the future.

>> reporter: if this case does go to trial as a death penalty case, the overwhelming evidence revealed in this preliminary hearing has legal analysts saying holmes ' only option is an insanity defense .

>> not only is this not a whodun it, but it's very likely a mission of the defense perspective just to save their client's life. life in prison would be a huge victory for the defense.

>> reporter: it will continue to be difficult in court this week. prosecutors have still photos and hours of video from the crime scene if they choose to show it. it is expected several victim survivors will also testify. matt?
